- cently reported that delinquencies in homeowner’s associations initially increased at the start of the pandemic, and then quickly leveled off. Tat means that Boards and Management should be able to clearly identify which owners may be eco- nomically impacted by the pandemic based on their payment history and are likely struggling to pay their assessments in a timely manner. Here’s a great example of where grace and governance con- verge.


Consider adopting a new, temporary collection policy. Allow for reasonable payment plans, waive late fees if payment plans are honored, and secure debt via liens as you normally would. Make sure to get everything in writing so all parties agree to the terms of the payment plan and engage legal counsel or your collection agency to ensure you are moving forward appropriately.

 the time to foreclose. Not only do foreclosures affect the values of neighboring homes (typically within 500 feet per foreclosure), but foreclosures add another level of oversight for Boards in a time when it may already be difficult to navigate ever- changing business practices. Aside from the two reasons not to foreclose described above, if you have a lien in place to protect the association, why not just hold off until we can all catch our breath and come out on the other side of the pandemic?


Community aesthetics and governance make liv- ing in a community association desirable and even valuable for many. In fact, studies show that homes located in homeowner’s associations - side of an association. It’s important to remain diligent in ensuring your association remains aesthetically pleasing and reducing governance on maintenance violations is never prudent.


However, it is reasonable to temporarily revise some rules. Indeed, the Board should recognize the ease in which grace in governance can be practiced, under reasonable circumstances that do not impact the association long-term.
