condominiumboardisgovernedbytheassociaonbylaws.N.J.S.A.46:8B13ofthe CondominiumActstatesthatthe“administraonandmanagementofthecondominium …andtheaconsoftheassociaonshallbegovernedbybylaws…”Subsecon(a) statesthatthebylawsshallspecify“thepowers,duesandmannerofselecon, removalandcompensaon,ifany,ofocersandboardmembers.”Therefore,to answerbothquesonsinNewJerseyonemustexaminethebylawsoftheparcular associaon.Thosebylawswilllistthequalicaonsofboardmembers.Oenbylaws willrestrictboardmembersto“unitowners”or“members”oftheassociaon(with “members”denedas“unitowners”).Insuchcases,aspouseorchildwhoisnotonthe deedwillnotbeeligibleforelecontotheboard.Thesameissueappliesto renters.Rentersmaybedeemed“associatemembers”entledtousethecommon elementsandrecreaonalfaciliesoftheassociaonbutnototherwiseentledtovote orbeelectedtotheboard.If,however,bothspousesarelistedonthedeed(orparent andchild)andthereisnoexpressprohibionontwomembersfromthesameunitbeing elected,twospouses(orparentandchild)couldbothrunfortheboard.
Mostbylawsforcondominiumassociaonswillrequirewheretherearetwoormore unitowners,thatoneownerbedesignatedasthevongmembersothatoneunitisnot casngtwovotes.Thatvongrestricon,however,doesnotcarryovertoeligibilityfor theboard.Ifthecurrentboardwantstopreventtwocoownersfromoneunitserving ontheBoard,itshouldamendthebylawstospecifythatrestricon.
