We anticipate an exciting and rewarding Illinois Legislative Session for the community associations industry in 2023.
We believe we have an opportunity in the upcoming year to pass new “Rules” to the CAM Licensing Act through the Joint Committee on Administrative Rules (JCAR). JCAR is composed of 12 legislators who are appointed by the legislative leadership, with the membership apportioned equally between the two houses and the two political parties. It is co-chaired by 2 members representing each party and each legislative house.
House Bill 5167 (Public Act 102-0970) was passed by the Illinois General Assembly and signed into law by the Governor to provide intended improvements and regulations to the CAM Licensing law, including but not limited to language providing that certificates of insurance must be provided upon request. In order for the new law to have any impact on the community associations industry, new Rules must be submitted by the Illinois Department of Professional Regulation (DFPR) to JCAR for review and approval of the new licensing “Rules.” This will ensure that the General Assembly is adequately informed of how the law is implemented through the agency rulemaking and facilitate public understanding of rules and regulations.
The Illinois Legislative Action Committee (ILAC) is working with and negotiating the proposed Rules with the Department of Financial & Professional Regulation and hopes to pass effective new Rules through JCAR that govern and protect our industry. We expect 2023 to be a busy time for us at the State Capitol!
Other important issues that need to be addressed include electric charging stations and solar panels at community associations. These are important issues that need our attention to detail to protect both homeowners and community associations. And, we expect other condo related legislation to be introduced and debated in the 2023 legislative session.
Those of us working at the Illinois Capitol to accomplish these goals cannot do so without your help. First, we need your ongoing commitment to participate in our grassroots efforts and maintain regular contact with your state Senator and Representative. (Many thanks to those of you who have contacted your legislators and hosted them at your place of business).
Second, we need your help to build our PAC so that we can respond to the many campaign contribution requests we receive from our legislative friends. Although the Nov. 8 election has come and gone at the time this article is published, the costs of political campaigns require continual fundraising activities. Therefore, we are asking you to contribute to the Illinois CAI PAC, either a personal or company contribution is much appreciated.
We will be asking Illinois State Legislators for their votes of support this coming year. In turn, we must be ready and able to assist them when they ask for our help in financing their election campaign.
