refusing to report to, or leaving, a work- place or worksite because the employee has a reasonable belief that the workplace or worksite is unsafe or preventing the employee from accessing the employee’s mobile device for safety-related purposes. SB 1127 (Atkins) – Workers’ Compen- sation Liability Presumptions – Tis bill would reduce the time period to file a claim from 90 to 75 days for certain injuries or illnesses, including hernia, heart trouble, pneumonia, or tubercu- losis, among others, sustained in the
course of employment of a specified member of law enforcement or a spec- ified first responder. If liability for one of these injuries has been unreasonably rejected, the amount of the penalty is set to be five times the amount of the benefits unreasonably delayed due to the rejection of liability. Te bill would limit the penalty to no more than $50,000. It would require the appeals board to determine the question of whether the rejection of liability is reasonable. Te bill would apply this provision to all injuries, without regard to whether the injury occurs before, on, or after the operative date of the bill. Te bill would shorten the time period for investigat- ing all workers’ compensation claims. Neutral. Chaptered by Secretary of State. Chapter 835, Statutes of 2022.
SB 1162 (Limón) – Pay Data Matrix – This bill requires employers of 100 or more employees to submit an annual pay data report to the Civil Rights De- partment (CRD) regardless of whether the employer is required to file an annual Employer Information Report (EEO-1) pursuant to federal law and expands the information employers must provide on these reports. Also, it requires employers with 15 or more employees to include the pay scale for a position in any job posting. Oppose. Chaptered by Secretary of State - Chapter 559, Statutes of 2022.
