KBVE NEWS Your New Kentucky Veterinary Medicine

On June 29, 2023, the new Kentucky Veterinary Medicine Practice Act (KRS Chapter 321) became ef- fective. Each KBVE credential holder should review changes in the law to ensure personal compliance. Below is an overview of key changes. (Note that compliance will be determined by the language in the KBVE statutes and administrative regulations, and not by the overview provided below.)


• Telemedicine (KRS 321.186) and Definitions for different types of Telehealth (KRS 312.181(60), (61), (62), (63), (64), (65), (66)) • Telemedicine is practiced anytime a licensee provides client-specific advice, diagnosis, prognosis, or prescription over any electronic media, including phone, text, video chat, etc.


• To practice telemedicine in Kentucky, a KBVE license is required • Telemedicine requires a current, valid VCPR (KRS 321.185): i.e., an in-person, medically ap- propriate visit within the last twelve (12) months. (Premises drive-bys do not qualify as medi- cally appropriate.)


• Telemedicine may be practiced at the discretion of the practitioner (it is not required)


• Allied Animal Health Professional (AAHP) Permit (KRS 321.181(1), (2), (3), (4)) • A new KBVE credential, the AAHP permit, now exists to provide a path for licensure for non-vet- erinarian practitioners of animal chiropractic


• KBVE is currently working with the Kentucky Board of Chiropractic Examiners (KBCE) and other stakeholders to develop administrative regulations to govern permit requirements and stan- dards for education


• Medical Records (KRS 321.187) • Medical records require basic medical information to be included (and cannot just be invoices) • Tere are specific conditions under which records are releasable • Records must be true and accurate • Record keeping requirements shall be defined in administrative regulation filed on July 12 with LRC; check the board’s website on the Practice Act page for the opportunity to provide public comment through September 30


• Veterinary Facility Registration, AAHP Facility Registration, and Voluntary Inspections (KRS 321.236) • All veterinary facilities shall initially register no later than June 30, 2025 for a fee of $100 • Te renewal deadline is scheduled for September 30, 2027, and every two (2) years thereafter • KBVE is currently developing administrative regulations which shall govern the application and renewal process, and future fees


• Inspections shall be voluntary • Interested stakeholders can plan to review standards for veterinary facilities in 2024; if you would like to participate in regulation development, email Vet@ky.gov
