an accident or injury to themselves or others, you can be certain that a lawsuit will follow. Each municipality in Illinois has their own rules concerning Beverage Alcohol Sellers and Servers Education and Training (BASSET license for short). If yourf
you sell or serve alcohol on a regular basis, you want to hire someone who is BASSET certified as well as carries their own general liability insurance and names your association as an additional insured so THEIR insurance would defend the association in a court of law.
Third –anytime an association makes a change in their amenities (such as opening a bar in the clubhouse, building
a new gazebo on your common area or changing association rules to allow alcohol to be consumed around your pool) be sure to call your association’s insurance agent. You might need to add additional property or liability limits as your exposures have changed. Unfortunately in this case, no one thought to call the PartyTime Condominium Association’s insurance agent and inform him or her of this new money-making venture. If someonef
was injured or
killed after being served (or overserved) in the Clubhouse, the Association could either have no insurance coverage to protect themselves or not enough insurance to pay damages. I am guessing that PartyTime’s insurance agent would have informed them that they needed to (a) hire a licensed, BASSET-certified and insured bartender, (b) have the Associationincluded as an additional insured on the bartender’s own insurance policy, (c) at the very least carry insurance limits high enough to coverany unexpected losses, and (d) have signs posted at the dock areak NO ALCOHOL PERMITTED.
