timing of when the Condo Act was initially created, many condominium associations in Illinois were built/developed after the Condo Act went into effect. However, the Condo Act has been amended on numerous occasions over the decades since it was created.


In contrast, CICAA was initially created in 2010 and applies to many Illinois common interest community associations (i.e., homeowner associations, townhome associations, etc.). Considering that CICAA has only been around for 15 years, many of the associations that CICAA applies to were built/developed before the creation of CICAA. What this means is that for a number of associations that are subject to CICAA, their governing documents were prepared prior to CICAA’s existence. Additionally, like the Condo Act, CICAA has been amended several times since its creation.


An association’s governing documents are typically prepared by the developer of the association before or during the building/development of the association. While each association’s governing documents are, presumably, prepared
