the unit owner’s written request. Furthermore, recall that Chicago associations are governed by the Chicago Privacy Ordinance, which should be carefully considered when a Chicago condominium association receives requests for unit owner contact information - the Chicago Privacy Ordinance expressly states that no unit owner (except board members) shall have the right to examine or make copies of a unit owner’s personal information, including email addresses and telephone numbers (unless two-thirds of all owners vote to opt out of the Chicago condominium privacy ordinance). The association can require the requesting unit owner to certify in writing that the records will not be used by the unit owner for any “commercial purpose or for any purpose that does not relate to the association.”


If the association has a “secret ballot” rule, while the ballots themselves must be provided, the association need not produce the identities of the voting members. Boards should be aware that individuals sometimes make unreasonable requests, often with the sole intent of frustrating the association’s administration – when such requests come in, it’s best to seek advice of legal counsel. Finally, the board should be aware that charges incurred can be assessed back to the requesting unit owner (including costs for copying the records).


As we’ve seen, the Illinois State Legislature sought to “thread the needle” by enacting legislation that gives owners within community associations the right to documents that impact their ownership interests – these communities are, after all, not-for-profit businesses in which all homeowners have a vested interest. At the same time, the Legislature tried to not overly-burden the administrators of the associations (the boards and managers). Whether the State of Illinois has achieved this goal is to-be-determined. But rest assured, last year’s amendment is not the last we’ve seen of changes to the document request process.
