November Educational Luncheon:
New Legislation Update

The November educational luncheon covered new legislation affecting community associations generally effective January 1, 2025, and was presented by Steven A. Roseman, Esq., Managing Partner at Roseman Law, APC; Louie A. Brown, Jr., Esq., Partner at Kahn, Soares & Conway, LLP; and Morgan Winegar, CMCA, AMS, Director of Client Relations at Optimum Professional Property Management, Inc., AAMC. The program was coordinated by James C. Harkins, IV, Esq. of Cane & Harkins LLP and Nicole Kardos, CMCA, AMS, of Optimum Professional Property Management, Inc., AAMC.
Among the various bills discussed, the following are three takeaways from the program:
Takeaway #1: Electronic voting was authorized for use community associations’ election or recall of directors or amendment of governing documents, subject to adoption of rules and procedures implementing and governing use of electronic voting
Takeaway #2: Repair and Maintenance Responsibility for Utilities. Unless an association’s governing documents otherwise provide or the utility provider is responsible for the maintenance and repairs, associations will be responsible to restore interruptions in gas, heat, water, or electrical services that begin in the common area. Associations are required to “commence the process” of repairs within 14 days of the interruption of service.
Takeaway #3: Reduced Quorum. Clarifi cations were made to the statutes authorizing a reduced quorum requirement of 20% at reconvened meetings for election of directors, including to provide (i) that the reduced quorum will be 20% of “all members,” rather than the “members voting” in the election, and (ii) that the “association,” rather than the “board” may call for the reconvened meeting where the 20% reduced quorum will apply.
