It is important to remember that a special assessment is approved unless rejected by 51% of the voting power in the association. The special assessment must also include budget disclosures as provided in RCW 64.90.525(2)(a)-(f). Typically, all owners will be charged for a special assessment even if not all owners will use the new component.

What parking space allocation issues can arise? What procedures can an association implement to be in compliance?

Another common challenge faced by associations in terms of communal EV charging stations is the allocation of parking spaces. As a result of the limitations of electrical infrastructure, associations may need to swap residents’ parking spaces to accommodate charging station use. Open communication can help minimize any hard feelings that may arise if residents perceive their new space assignment as a downgrade.

Residents may need to swap parking spaces for charging station use.

The reality is that it will be much less expensive to locate EV charging spaces closer to the electrical panel. Alternatively, associations can implement shared spaces for charging equipment, (just be sure to formalize a shared-use policy so residents don’t monopolize shared spaces), or proactively wire the majority of the parking garage to anticipate this need.

Other Considerations

Your EV charging station should be clearly visible to EV drivers and have adequate lighting for safety. Visibility becomes especially important if you install your EV charging station in a parking garage or lot. EV charging infrastructure must also comply with all accessibility laws, such as the Americans with Disabilities Act (ADA), and include proper signage.

Installing an EV charging station is an important, high- value project. Given the likely heavy capital investment in infrastructure, associations will want to take appropriate steps to ensure all goes smoothly. A key part of those steps is seeking a licensed, bonded contractor with experience in EV charging infrastructure installation. A skilled contractor will pull all necessary permits and manage all required inspections. If you need help locating a contractor, see if your property management company is able to provide a referral.

Lastly, when transitioning to an EV-friendly community, expect the process to take at least six months, including the initial exploratory phase with your residents, infrastructure, utilities, and vendors. Each association has its own unique challenges, and those should be taken into consideration when thinking about timing and implementation of the project.
