Allowing Private Functions
and Events To be sure, public events on association property is different from allowing owners and residents to use private meeting and recreation space to host birthday parties and similar such events. The association maintains much more control over who is accessing the property, which removes many of the security concerns, while also ensuring that the association does not become open to the public, triggering all the ADA requirements for access.
Still, the board should have a carefully-drafted set of rules to ensure that the private events remain safe and well-controlled, especially where there may be alcohol served. The board wants to prevent an owner from renting out the recreation room for a “small gathering” only to later learn that the owner decided to hold her very own “Woodstock” on the association property, complete with booze, loud music, and 1,500 of her closest “friends”!
