Changes Afloat in Air and Water Quality Regulatory Arena

alifornia regulators never rest, especially those working in air and water quality. Contractors

regulations to ensure compliance. Here are just some of the new developments that bear watching.


Changes for Fleet Owners For contractors with large trucks,


the regulatory landscape is changing rapidly. A recent court decision invali- dated the portions of the On-Road Truck regulation that provided a Low Use Exemption of 1000 annual miles, removed the exemption for areas of the state that have no NOx problem and cancelled the heavy crane phase in option for crane owners. Tis means by year end, these fleets will need to be in compliance with engine model year schedule in the regulation. Fleet owners believe this will have a profoundly negative effect on fleets around the state and are pushing the California Air Resources Board (CARB) to provide some relief. Stay tuned for further developments. Changes are also forthcoming


to the Periodic Smoke Inspection Program that will link opacity testing and reporting to vehicle regis- tration. Tis new annual reporting will place a considerable burden on existing fleets and will do little to identify those fleets that have been non-compliant. Out-of-state fleets will not be burdened with reporting. It will become an enforcement nightmare for truck owners and CARB staff as well. Te Construction Industry Air
