Creating & Enforcing Fair Rules & Reglations

when discussing a challenged current rule or proposed new rule is, “Is it enforceable?” If it is not enforceable, there is no point in keeping or setting a rule/regulation. Yet, today, many associations’ governing documents (especially Rules and Regulations) lack enforceable policies.

If a poorly written set of rules has been in place for a long period, it is well worth the time and commitment to update them. However, care must be taken to ensure each rule is written or changed to be a balance of reason and enforceability; all-encompassing and basic, yet unambiguous; specific and concise, yet detailed enough to provide a clear understanding.


Selecting a committee to do the legwork of such a great undertaking is wise; though keep in mind that often the ones that raise their hands to volunteer for such a committee are the rule-breakers, the envelope- pushers, and the disgruntled owners. That being said, a careful selection of members to serve on such a committee is important.
