New Protections for Free Speech on the Internet: AB 1410

In 2018 the California legislature enacted Civil Code section 4515. It was designed to protect a resident’s right to political speech and peaceful assembly. The State Senator who introduced the law in 2017 did so because he was under the impression that homeowners association board members were denying these rights to the residents and taking disciplinary action against them when they tried to exercise these rights. In more than twenty-fi ve years of representing homeowners associations, I have never seen an example of a board disciplining a resident for expressing his/her opinion.
