FMCSA Issues Emergency Declaration for Transportation of Baby Formula
The Federal Motor Carrier Safety Administration has issued an Emergency Declaration for the trans- portation of baby formula ingredients for the produc- tion of baby formula and its components, including but not limited to whey, casein, corn syrup and hydrolyzed protein, and containers and packaging for baby formula in response to a nationwide emergency as declared by the White House.
Motor carriers and drivers providing direct assistance to the emergency in direct support of relief efforts related to the emergency as set out in this declara- tion are granted relief from 49 CFR § 395.3, maximum driving time for property- carrying vehicles, subject to the restrictions and condi- tions set forth herein. Direct assistance does not include routine commercial deliver- ies, including mixed loads with a nominal quantity of qualifying emergency relief added to obtain the benefits of this emergency declara- tion. To be eligible for relief from 49 CFR § 395.3, the transportation must incident to the immediate restoration of baby formula supplies.
FMCSA Extends Expanded COVID Emergency Declaration that Includes Heating Fuels The Federal Motor Carrier Safety Administration has extended its ex- panded Emergency Declaration (
www.fmcsa.dot. gov/emergency/extension- and-amendment-modified-
emergency-declaration- no-2020-002-under-49-cfr- ss-39025 ) that addresses national emergency condi- tions that create a need for immediate transportation of essential supplies and provides necessary hours of service relief from the FMCSRs for motor carriers and drivers. The Emergency Declaration is now in effect through August 31, 2022. Under the declaration, motor carriers and drivers providing direct assistance in support of relief efforts related to the COVID-19 public health emergency are granted emergency relief from 49 CFR § 395.3, maxi- mum driving time for prop- erty-carrying vehicles, for the following commodities: livestock and livestock feed; medical supplies and equipment related to the testing, diagnosis and treat- ment of COVID-19; vaccines, constituent products, and medical sup- plies and equipment includ- ing ancillary supplies/kits for the administration of vaccines, related to the pre- vention of COVID-19; supplies and equipment necessary for community safety, sanitation, and pre- vention of community trans- mission of COVID-19 such as masks, gloves, hand sanitiz- er, soap and disinfectants; food, paper products and other groceries for emergen- cy restocking of distribution centers or stores; gasoline, diesel, jet fuel, ethyl alcohol, and heating fuel including propane, natu- ral gas, and heating oil; and supplies to assist indi- viduals impacted by the con- sequences of the COVID-19
pandemic (e.g., building materials for individu- als displaced or otherwise impacted as a result of the emergency).
FMCSA previously
amended the commodities covered by the Emergency Declaration to include heat- ing fuel including propane, natural gas, and heating oil to address particular fuel needs arising out of the ongoing emergency and to broaden the categories of fuel shipments covered.
CVSA Launches Revised Emergency Declarations Website
The Commercial Vehicle Safety Alliance has launched a revised emergency declara- tions website (
www.cvsa.org/ news/revitalized-emergency- declarations-site/ ) in con- junction with the Federal Highway Administration and the American Association of State Highway and Transportation Officials. The emergency decla- rations website now also provides: Information on changes to allowable weights through a standard set of pertinent information, which includes contact information for each state’s overweight permitting office An interactive map of dec- larations throughout Canada, Mexico and the U.S. The ability to subscribe to notices of new declarations Information on the issuer of the relief, the type of re- lief granted, and emergency declarations’ beginning and end dates Comprehensive exemption details, including all rel- evant information for vehicle
permits for size, overweight restrictions on interstates, waivers for overweight re- strictions on state roads, and marking and lighting relief Contact information for the jurisdiction’s issuer
Previously, the emer- gency declarations website focused solely on emergency relief of the Federal Motor Carrier Safety Regulations provided to motor carriers through the states or the Federal Motor Carrier Safety Administration.
CVSA states that during an emergency, moving relief supplies efficiently to an affected area may require shippers to route through multiple jurisdictions. To facilitate speedy delivery of such supplies, jurisdictions may use emergency declara- tions to temporarily alter certain requirements for shippers and motor carri- ers. There may be multiple sources of information about waivers, amendments, exten- sions, exemptions, execu- tive orders, etc., as well as changes to allowable vehicle weights issued during emer- gencies, which results in confusion among drivers, shippers, motor carriers and state departments of trans- portation. The emergency declarations website aims to eliminate that confusion by offering one easy-to-access, up-to-date public online re- pository that the commercial motor vehicle enforcement community and the motor carrier industry may refer- ence at any time.
