Paper ballots (sample here) are inherently prone to errors. Voters often make mistakes, change their minds, or add marks and information that cannot be read—leaving the inspectors of the election to guess a voter’s intentions. Online voting eliminates mismarked or improperly voted ballots by requiring that users meet preset guidelines before their ballot is accepted—increasing the number of usable votes. Unlike paper ballots, most systems records the date and time of the vote and gives the user confirmation that his or her vote was received and then separates the vote from the user’s identity to ensure anonymity. In the event of a disputed election, votes can be instantly recounted. The CAI-CLAC asserts that in legal instances, “the primary evidence relied upon is the certification of the inspector of elections, not the actual ballots.”


Associations need to be diligent in choosing a reputable online-election company that offers a secure platform with flexible capabilities that will comply with all HOA governing documents and state regulations.


Despite the conveniences, online voting does not guarantee a quorum is always met. Studies do show that response rates with online voting tend to increase, but communication is still the key to voter participation. To that effect, online systems allow close monitoring of response rates. If needed, e-communication and social media are powerful tools to encourage homeowners to vote—avoiding costly and exhausting adjournments or re- elections.


Hopefully, it is only a matter of time before online voting is a reality for most homeowners associations…


   
