Among all of the things that happened in 1976 – the movie Rocky was released in theaters, Jimmy Carter was elected President, the first commercial flights of the supersonic Concorde occurred, Peter Frampton released “Frampton Comes Alive”, and the NBA (National Basketball Association) merged with the ABA (American Basketball Association) – the Illinois chapter of Community Associations Institute was born. From humble beginnings, the CAI Illinois Chapter has grown to become a significant part of the community association industry and has received several recognitions at the national level during its 50 years.
In 1976, community associations, as an industry in Illinois, was still early in its formation. The Illinois Condominium Property Act (ICPA) was only thirteen years old and was very different than it is today. In 1963, the ICPA introduced a new form of property ownership to Illinoisans – the condominium. The condominium provided for a form of shared ownership of real property. A person could purchase a unit in the condominium as he or she would a single-family home. However, the purchaser would also have an ownership interest in the building, and surrounding property, in which the unit is situated. The “unit owner” would own not only his or her unit, but also the common property (i.e., the condominium property other than the units, a/k/a the common elements) as tenants in common with all the other unit owners. Without going into a detailed legal analysis and history of property ownership – I suggest going to law school for that – the enactment of the ICPA was significant.
