The November educational luncheon covered new legislation affecting community associations generally effective January 1, 2022, and was presented by Jeffrey A. Beaumont, Esq., CCAL, of Beaumont Tashjian, Louie A. Brown, Jr., Esq., of Kahn, Soares & Conway, LLP, and Brittany Kitts, CMCA, AMS, of Total Property Management, Inc., AAMC. The program was coordinated by James C. Harkins, IV, of Cane & Harkins LLP.
Three takeaways from the program include the following:
Takeaway #1:
Effective September 23, 2021, new powers and procedures were adopted for holding meetings exclusively via tele/videoconferencing when a state of disaster or emergency is declared by a federal, state, or local governing body.
Takeaway #2:
Elections: • Elections for directors may be conducted by acclamation subject to complying with specified procedures;
• Term limits were added to the permissible list of director qualifications; and • Procedures were added for confirming whether candidates are qualified.
Takeaway #3:
Lot Splitting. Local governing authorities are required to approve lot splitting in planned developments; provided, however, the statute does not supersede restrictions in CC&Rs prohibiting splitting of lots.
