March Educational Luncheon CAI-OC’s Panel of Pundits Present: The Great Debate—Perspectives on Today’s Most Difficult HOA Challenges
CAI’s Panel of Pundits really knocked it out of the park at the March Educational Luncheon. Over 300 managers and vendors were educated and entertained by attorneys Matt Ober of Richardson Ober LLP, Lisa Tashjian of Beaumont Tashjian, and Fred Whitney of Whitney Petchul Attorneys at Law, in an interactive presentation moderated by ShawnMarie Ward of The Vintage Group. The Panel of Pundits discussed such disparate topics as:
• Rentals in the community. We learned that room rentals in a home are not necessarily considered a business use of the home. Discretion must be used when faced with this issue. Enforcement may be warranted if the room rentals create a “nuisance”.
• Negative comments about the association on social media. We learned that Civil Code 4515 protects homeowners when making comments on social media, whether the comments are positive or negative. Boards need to create a way to handle these issues without trying to “silence the opposition”.
• Homeowner use of Ring, Nest, and other security type cameras have created instances where these cameras are recording neighbors as they relax in their own yards. We learned that due to this type of technology, the expectation of privacy is lower than it has been in the past. Sometimes these are homeowner to homeowner issues, and sometimes it becomes a community issue, depending on how intrusive the cameras are.

This program truly “Aspired to Inspire”, as it was lively and interactive. The audience had many questions, and Kimberly Lilley from Berg Insurance adroitly stepped in with a mobile mic to help the panel field them. As always when dealing with these kinds of homeowner issues, the importance of open communications cannot be overstated!
