May Educational Luncheon –
Hazards that Impact Insurance

The May educational luncheon covered insurance coverage issues, and was presented by Patrick Prendiville, Prendiville Insurance Agency, Flint Faulkner, Action Property Management, Inc., and Laurie F. Masotto, Esq., Community Legal Advisors, Inc. The program was coordinated by James C. Harkins, IV, Esq., of Cane & Harkins LLP, and Michael Davie of Valley Bank.
The following are three takeaways from the program:
Takeaway #1: Several conditions are tightening the insurance market in California, which in the short term are expected to continue, negatively impacting the availability of insurance, the scope of coverage, and the expense of insurance.
Takeaway #2: Underwriters are more critically analyzing (i.e., denying claims on) damages claims arising from deferred maintenance issues, such as roof leaks. Thus, Associations should take a closer look at maintenance that is being deferred to reduce the risk of damages. Associations should establish policies, such as a water intrusion policy, that details procedures, responsibility for insurance deductible, repair responsibility, and includes an admonition for owners to maintain insurance coverage for their personal property.
Takeaway #3: When retaining contractors, (i) ensure the written contract requires the contractor to name the Association and managing agent as additional insureds, (ii) obtain a copy of the actual policy endorsement; the Certificate of Insurance does NOT confirm additional insured coverage, and (iii) work with your insurance agent and legal counsel to ensure that important coverage needs are not excluded from the contractor’s insurance policies.
