Tis measure creates a new body of law for “egregious” employers, as defined, and would require Cal/OSHA to issue citations for each willful violation; each exposed employee would be considered a separate violation for purposes of fines and penalties. It would create a rebuttable presumption that the employers’ actions were retal- iatory if an employer takes an adverse action within 90 days. Also, it provides Cal/OSHA with the authority to issue a citation and seek a suspension or temporary restraining order for large employers when their policies directly violate labor and health and safety standards.
