At first glance, calling a homeowner to a hearing seems simple and straightforward. However, this discussion took a deep dive into enforcement procedures, potential issues, and best practices for associations to consider. Specifically, CAI-OC’s June Educational Program titled, “Enforcement Strategies: What to Know and What to Avoid” highlighted various important legal nuances, valuable tools, statutory rules, and requirements to know when attempting to gain homeowner compliance with the governing documents.
The discussion was led by two leading HOA attorneys, Laurie S. Poole, Esq., CCAL of Adams | Stirling PLC and Robert M. DeNichilo, Esq., CCAL of Nordberg | DeNichilo, LLP, who made a point to emphasize the importance of an enforcement strategy to achieve the ultimate goal of compliance. Attendees learned how to effectively implement enforcement processes, beginning with the scope of enforcement and authority in the governing documents, rules related to the notice of hearing, fines, and hearing procedures. Ensuring the association has an effective and flexible fine and enforcement policy was also an important topic that was skillfully woven throughout the program. Managers, board members, and industry partners left with new ideas and enforcement practices to implement going forward.
