2022 Year in Review and 2023 Outlook


2022 was another busy year for ILAC. We held our first Virtual Advocacy programs, one for the Illinois House and one for the Senate. These programs afforded the opportunity for legislators and their staffs to become familiar with ILAC and vice versa. The programs also gave CAI members the opportunity to learn more about ILAC and the legislative process. We successfully worked with legislators and other interested parties to amend various bills affecting community associations, some of which became law (e.g., Public Act 102-0970/HB 5167 and Public Act 102-0976/HB 5246) and some that did not (e.g., HB3125). In addition to dealing with pending bills, ILAC worked with the representatives of the solar energy industry on potential legislation expected to be introduced in 2023 that will amend the Homeowners Energy Policy Statement Act. Additionally, ILAC has been working with the Illinois Department of Financial and Professional Regulation on draft administrative rules covering community association managers expected to be published and approved in 2023


ILAC anticipates 2023 to be another busy year. To kick off the year, nearly a dozen members traveled to Springfield with our lobbyist, Jeff Dixon, and met with over twenty legislators through pre-set meetings and outside the House & Senate Chambers to discuss key issues of the CAI bills-of-the-day, including solar energy and electric vehicle charging stations. CAI ILAC also hosted a dinner with Senators and Representatives to further the discussions. If you were not able to join us in Springfield, hopefully you could participate in the Virtual Advocacy days, where we meet with legislators in a virtual town hall format to discuss community association issues. We expect that other bills will cover a variety of issues, such as personal information of owners, deferred maintenance, reserves, etc. We know there will also be new administrative rules governing community association managers and ILAC plans to be involved in these legislative discussions.


BILLS THAT DID NOT BECOME LAW IN 2022: HB3125


This bill created a new Electric Vehicle Charging Act, which would impose requirements upon community associations with respect to electric vehicle charging stations. Among other things, the bill addressed owner rights to install electric vehicle charging stations. ILAC worked with the bill’s sponsor to amend language


BILLS THAT BECOME LAW IN 2022: Public Act 102-0970 (HB 5167)


The Public Act makes changes to Sections 10, 25, 55, 60, and 65 of the Community Association Manager Licensing and Disciplinary Act. ILAC worked closely with the Illinois Department of Financial and Professional Regulation on drafting the language HB1467 and supported the bill.


Public Act 102-0976 (HB 5246)


The Public Act amended Section 22.1 of the Condominium Property Act. ILAC worked very closely with Representative Wheeler, Senator Cappel, and other interested parties on this HB5246. CAI National, through Dawn Bauman and Phoebe Neseth, assisted ILAC in negotiations with legislators, as well as multiple “calls to action” sent to CAI members. The bill, in the form passed by both Houses, was


the result of much discussion between ILAC and the bill sponsors. Overall, ILAC was successful in working with the bill sponsors to achieve a reasonable compromise that is consistent with how other states have addressed similar issues and supported the bill to that extent.
