March Educational Luncheon

The March educational luncheon included a discussion on SB 326/Civil Code Section 5551, and ways that associations can manage balcony inspection and repair compliance. It was presented by Michael T. Kennedy, Jr., Esq. of Berding I Weil LLP, Dilip Khatri, PhD. SE of Khatri International, Inc., and Alain Vina of PCW Contracting Services. The program was coordinated by Laurel Dial of Consensys Property Management and Teresa Rueda of Painting Unlimited, Inc.
► Takeaway #1 Effective January 1, 2020, every association with buildings of three or more units, must have all association-maintained load-bearing exterior, elevated elements and their associated waterproofing systems, inspected every nine years (with exceptions noted below). The report of inspection becomes an association record, and the first inspection and report must be completed by January 1, 2025.
► Takeaway #2 What is not included in SB 326: • Concrete or steel balconies and raised elements; • Components with a walking surface lower than six feet; • Components not intended for human use (like a roof); and • Planned Urban Developments (PUDs).
► Takeaway #3 What is involved in the inspections? • Inspections must be performed by licensed architects or structural engineers.
• Testing must include a large enough sample to ensure a 95% certainty for the entire project. The sample size and testing locations are determined by the inspector.
• The testing is not just a visual scan but involves opening each balcony or raised element to inspect the structural elements for rot, decay or other issues that could lead to failure.
Don't wait! This is potentially a costly project, and the sooner associations can inspect and repair their balconies and raised elements, the less likely they will encounter delays and increased costs as the January 1, 2025 deadline rapidly nears.
