INDUSTRIAL RELATIONS New Manager Named for AGC Industrial

Relations, Northern California AGC of California recently announced

the addition of Albert Aragon as the Manager of Industrial Relations North- ern California. He will manage all labor relations advocacy for the northern terri- tories that AGC represents in California. Aragon comes to AGC with a back-

The Takeaway What with the fact that Moffatt “gra-

tuitously” reviewed and approved State’s concrete design mix and State botched its own design mix by figuratively just throw- ing in a pinch there and a pound there of air entrainment chemical, the Court of Appeal’s opinion may seem to have been a foregone conclusion. But cases are often stories in morality,

and judges and justices alike can’t just an- nounce that one party is victorious over another because it was “the right thing to do.” Indeed, I could see this case going the other way if Moffatt was contractually responsible for reviewing and approving State’s concrete design mix and if State fol- lowed the concrete design mix approved by Moffatt. If there’s anything to take from this case

it’s that “in general,” courts are reluctant to extend what should otherwise be a con- tract claim into a claim “sounding in tort,” that equitable claims such as equitable in- demnity and contribution are subject to greater scrutiny, and that such claims will not be permitted where there are no actual damages but merely economic loss.

worked for the Contra Costa County as a Principle Labor Relations Negotiator. While at Contra Costa County, Albert managed the Labor Relations Depart- ment, which supported 32 county depart- ments. During his time as the Principle Labor Relations Negotiator, he managed all county labor relations staff during the simultaneous negotiations of 12 separate bargaining units and established labor management meetings to facilitate prob- lem resolution and improve bargaining unit relationships.
