The February luncheon, moderated by Matthew Boomhower of Southern Cross Property Consultants, Farrah Esquer, CMCA, AMS, PCAM of Cardinal Property Management, AAMC, and John R. MacDowell, Esq., CCAL of Fiore, Racobs & Powers, A PLC, shed light on crucial aspects of addressing the housing crisis in California, where a shortage of affordable housing has become a pressing issue for planned developments. While Accessory Dwelling Units (ADUs) are considered a potential solution, legislators remain committed to exploring avenues for affordable housing in the state.
One key takeaway from the luncheon emphasized the unique status of ADUs as individual living spaces. Participants were reminded that local laws cannot be more restrictive than state laws, and Civil Code Section 4751 allows planned developments to impose reasonable restrictions. This includes the adoption of architectural guidelines specific to ADUs, covering aspects such as materials and color.
Furthermore, planned developments may impose a 30-day minimum rental requirement for ADUs, ensuring a balance between short-term and long- term housing solutions. Notably, only governing documents with variable assessments can be applied to ADUs, preventing the imposition of additional assessments on these units. Please ensure you reach out to your association’s legal counsel for guidance.

The luncheon also highlighted the need for clear rules regarding ADU-related issues, such as the number of key fobs allowed per unit. This ensures that community guidelines are comprehensive and address potential challenges that may arise with the integration of ADUs into existing developments. A significant point of discussion revolved around the potential need to revise solar panel policies to accommodate building codes for ADUs. This adjustment would align with the State’s push for sustainable practices in new construction.
In summary, the speakers provided valuable insights into navigating the intricacies of planning for ADUs as a response to the affordable housing crisis. With a focus on legislative commitments, local regulations, and emerging laws, participants gained a better understanding of the “Ins & Outs” of effectively incorporating ADUs into their communities.
