Defamation is a general term, while slander and libel refer to particular types of defamation. Libel is written defamation, and slander is verbal. Accordingly, social media defamation refers to a libelous or slanderous statement and/or content which is made on a social media platform.


Defamation typically requires proof of four elements:


1. A false statement of fact:


There must be a false assertion of fact in the subject matter about a person, business, or organization.


2. Publication to a third party:


A false assertion of fact must have been communicated or published to a third-party audience.


3. Fault:


The party who published or communicated the statement must have done so with fault amounting to at least negligence.


4. Damage:


The statement or publication in question must have caused harm or damage to the person, business or organization.
